Knight accepts Nasdaq's $62 million Facebook payback plan

(Reuters) - After heaping criticism on Nasdaq OMX Group's initial offer for compensating brokers for its botching of Facebook's initial public offering, trading firm Knight Capital Group Inc said it accepts the exchange's latest plan, which would pay out $62 million.

The plan, which Nasdaq has called its "definitive word" on the Facebook debacle, is under consideration by the SEC and brings into question the extent to which an exchange can be liable for technical slip-ups. U.S. exchanges match hundreds of billions of dollars of securities transactions every day.

Knight's support comes after Nasdaq increased the payback fund to $62 million in cash from an earlier $40 million, made up mostly of trading rebates, the market-making firm said in a letter to the U.S. Securities and Exchange Commission, dated August 29.

Nasdaq has around 300 member firms that trade on the exchange. Knight and other retail market-making firms and brokers together lost more than $500 million in the IPO.

Of the handful of comment letters on the compensation plan, two have voiced support: Knight's and hedge fund Citadel's. Seven -- from market makers, brokers, and lawyers for individual investors -- have called for it to be rejected.

"Although we would have preferred that the accommodation pool cover all losses sustained by Nasdaq members, we do support Nasdaq's proposal," Knight said in the letter.

Knight, which facilitates trades for other firms, had called Nasdaq's earlier plan "inadequate," and said it was considering legal action over the Facebook IPO.

Liabilities at exchanges, which have some regulatory duties, are capped in most instances. Nasdaq's cap is $3 million.

Much of the debate around the plan has focused on whether Nasdaq should be able to cloak itself in regulatory immunity in situations where it is operating as a for-profit entity.

LIABILITY

Facebook's eagerly anticipated IPO on May 18, which raised $16 billion, was initially delayed by 30 minutes due to a technical glitch at Nasdaq.

The exchange then made the decision to get the stock trading by using a secondary system that ended up leading to delays in many clients orders and confirmations, costing some investors and traders big losses as the stock price dropped after an initial gain.

UBS AG, which disclosed it lost more than $350 million, and Citigroup's Automated Trading Desk, which is said to have lost up to $35 million, have argued that Nasdaq should be responsible for all of the losses, because the decision to move forward with the IPO was a business decision made in haste.

Further, Citi said trading of Facebook should not have been allowed to continue during the confusion that followed.

But Knight, which said it lost more than $35 million in the IPO, urged the SEC to leave the discussion of liability limitations and regulatory immunity to another day. Citadel, which is said to have lost $20 million, made a similar request.

RELEASE WAIVER

Knight did urge the SEC to reject a portion of Nasdaq's plan requiring firms that sign on to waive their right to sue the exchange, likely before they know how much they will be reimbursed. Knight said that would set "a harmful precedent."

"Setting forth those types of requirements in the context of a rule filing inappropriately mixes commercial issues with regulatory requirements," Knight said in the three-page letter also addressed to SEC Chairman Mary Schapiro.

It said if the SEC disagrees and determines that some form of release is appropriate, it should only be sought after Nasdaq members are notified of the amount Nasdaq is willing to pay under the terms of the accommodation plan.

A Nasdaq spokesman had no comment on Knight's letter.

Nasdaq also faces regulatory investigations into its systems and actions during the IPO.

Knight had its own trading glitch on August 1, costing the firm $440 million and nearly forcing it into bankruptcy before a group of independent firms saved it with a $400 million investment.

Here are the prepared remarks for GOP Vice Presidential nominee Paul Ryan, as provided to reporters by the Mitt Romney campaign:

Mr. Chairman, delegates, and fellow citizens: I am honored by the support of this convention for vice president of the United States.

I accept the duty to help lead our nation out of a jobs crisis and back to prosperity ? and I know we can do this.

I accept the calling of my generation to give our children the America that was given to us, with opportunity for the young and security for the old ? and I know that we are ready.?

Our nominee is sure ready. His whole life has prepared him for this moment ? to meet serious challenges in a serious way, without excuses and idle words.? After four years of getting the run-around, America needs a turnaround, and the man for the job is Governor Mitt Romney.

I?m the newcomer to the campaign, so let me share a first impression.? I have never seen opponents so silent about their record, and so desperate to keep their power.?

They?ve run out of ideas.? Their moment came and went. Fear and division are all they?ve got left.???

With all their attack ads, the president is just throwing away money ? and he?s pretty experienced at that.? You see, some people can?t be dragged down by the usual cheap tactics, because their ability, character, and plain decency are so obvious ? and ladies and gentlemen, that is Mitt Romney.?

For my part, your nomination is an unexpected turn.? It certainly came as news to my family, and I?d like you to meet them: My wife Janna, our daughter Liza, and our boys Charlie and Sam.?

The kids are happy to see their grandma, who lives in Florida.? There she is ? my Mom, Betty.?

My Dad, a small-town lawyer, was also named Paul.? Until we lost him when I was 16, he was a gentle presence in my life.? I like to think he?d be proud of me and my sister and brothers, because I?m sure proud of him and of where I come from, Janesville, Wisconsin.????

I live on the same block where I grew up.? We belong to the same parish where I was baptized.? Janesville is that kind of place.

The people of Wisconsin have been good to me.? I?ve tried to live up to their trust.? And now I ask those hardworking men and women, and millions like them across America, to join our cause and get this country working again.

When Governor Romney asked me to join the ticket, I said, ?Let?s get this done? ? and that is exactly, what we?re going to do.?

President Barack Obama came to office during an economic crisis, as he has reminded us a time or two.? Those were very tough days, and any fair measure of his record has to take that into account.? My home state voted for President Obama. When he talked about change, many people liked the sound of it, especially in Janesville, where we were about to lose a major factory.?

A lot of guys I went to high school with worked at that GM plant. Right there at that plant, candidate Obama said: ?I believe that if our government is there to support you ? this plant will be here for another hundred years.?? That?s what he said in 2008.

Well, as it turned out, that plant didn?t last another year.? It is locked up and empty to this day.? And that?s how it is in so many towns today, where the recovery that was promised is nowhere in sight.?

Right now, 23 million men and women are struggling to find work.? Twenty-three million people, unemployed or underemployed.? Nearly one in six Americans is living in poverty.? Millions of young Americans have graduated from college during the Obama presidency, ready to use their gifts and get moving in life.? Half of them can?t find the work they studied for, or any work at all.?

So here?s the question: Without a change in leadership, why would the next four years be any different from the last four years?

The first troubling sign came with the stimulus.? It was President Obama?s first and best shot at fixing the economy, at a time when he got everything he wanted under one-party rule.? It cost $831 billion ? the largest one-time expenditure ever by our federal government.

It went to companies like Solyndra, with their gold-plated connections, subsidized jobs, and make-believe markets. The stimulus was a case of political patronage, corporate welfare, and cronyism at their worst. You, the working men and women of this country, were cut out of the deal.??

What did the taxpayers get out of the Obama stimulus?? More debt.? That money wasn?t just spent and wasted ? it was borrowed, spent, and wasted.????

Maybe the greatest waste of all was time. Here we were, faced with a massive job crisis ? so deep that if everyone out of work stood in single file, that unemployment line would stretch the length of the entire American continent.? You would think that any president, whatever his party, would make job creation, and nothing else, his first order of economic business.??

But this president didn?t do that.? Instead, we got a long, divisive, all-or-nothing attempt to put the federal government in charge of health care.?

Obamacare comes to more than two thousand pages of rules, mandates, taxes, fees, and fines that have no place in a free country.??

The president has declared that the debate over government-controlled health care is over.? That will come as news to the millions of Americans who will elect Mitt Romney so we can repeal Obamacare.

And the biggest, coldest power play of all in Obamacare came at the expense of the elderly.?

You see, even with all the hidden taxes to pay for the health care takeover, even with new taxes on nearly a million small businesses, the planners in Washington still didn?t have enough money.? They needed more.? They needed hundreds of billions more.? So, they just took it all away from Medicare.? Seven hundred and sixteen billion dollars, funneled out of Medicare by President Obama.? An obligation we have to our parents and grandparents is being sacrificed, all to pay for a new entitlement we didn?t even ask for.? The greatest threat to Medicare is Obamacare, and we?re going to stop it.?

In Congress, when they take out the heavy books and wall charts about Medicare, my thoughts go back to a house on Garfield Street in Janesville.? My wonderful grandma, Janet, had Alzheimer?s and moved in with Mom and me.? Though she felt lost at times, we did all the little things that made her feel loved.?

We had help from Medicare, and it was there, just like it?s there for my Mom today.? Medicare is a promise, and we will honor it.? A Romney-Ryan administration will protect and strengthen Medicare, for my Mom?s generation, for my generation, and for my kids and yours.?

So our opponents can consider themselves on notice.? In this election, on this issue, the usual posturing on the Left isn?t going to work.? Mitt Romney and I know the difference between protecting a program, and raiding it.? Ladies and gentlemen, our nation needs this debate.? We want this debate.? We will win this debate.???

Obamacare, as much as anything else, explains why a presidency that began with such anticipation now comes to such a disappointing close.?

It began with a financial crisis; it ends with a job crisis.?

It began with a housing crisis they alone didn?t cause; it ends with a housing crisis they didn?t correct.?

It began with a perfect Triple-A credit rating for the United States; it ends with a downgraded America.?

It all started off with stirring speeches, Greek columns, the thrill of something new.? Now all that?s left is a presidency adrift, surviving on slogans that already seem tired, grasping at a moment that has already passed, like a ship trying to sail on yesterday?s wind.

President Obama was asked not long ago to reflect on any mistakes he might have made.? He said, well, ?I haven?t communicated enough.?? He said his job is to ?tell a story to the American people? ? as if that?s the whole problem here? He needs to talk more, and we need to be better listeners????

Ladies and gentlemen, these past four years we have suffered no shortage of words in the White House.? What?s missing is leadership in the White House.? And the story that Barack Obama does tell, forever shifting blame to the last administration, is getting old.? The man assumed office almost four years ago ? isn?t it about time he assumed responsibility?

In this generation, a defining responsibility of government is to steer our nation clear of a debt crisis while there is still time.? Back in 2008, candidate Obama called a $10 trillion national debt ?unpatriotic? ? serious talk from what looked to be a serious reformer.?

Yet by his own decisions, President Obama has added more debt than any other president before him, and more than all the troubled governments of Europe combined.? One president, one term, $5 trillion in new debt.

He created a bipartisan debt commission. They came back with an urgent report.? He thanked them, sent them on their way, and then did exactly nothing.

Republicans stepped up with good-faith reforms and solutions equal to the problems.? How did the president respond?? By doing nothing ? nothing except to dodge and demagogue the issue.

So here we are, $16 trillion in debt and still he does nothing.? In Europe, massive debts have put entire governments at risk of collapse, and still he does nothing. And all we have heard from this president and his team are attacks on anyone who dares to point out the obvious.?

They have no answer to this simple reality: We need to stop spending money we don?t have.

My Dad used to say to me: ?Son.? You have a choice: You can be part of the problem, or you can be part of the solution.?? The present administration has made its choices.? And Mitt Romney and I have made ours: Before the math and the momentum overwhelm us all, we are going to solve this nation?s economic problems.?

And I?m going to level with you: We don?t have that much time.? But if we are serious, and smart, and we lead, we can do this.

After four years of government trying to divide up the wealth, we will get America creating wealth again. With tax fairness and regulatory reform, we?ll put government back on the side of the men and women who create jobs, and the men and women who need jobs.?

My Mom started a small business, and I?ve seen what it takes. Mom was 50 when my Dad died.? She got on a bus every weekday for years, and rode 40 miles each morning to Madison.? She earned a new degree and learned new skills to start her small business.? It wasn?t just a new livelihood.? It was a new life.? And it transformed my Mom from a widow in grief to a small businesswoman whose happiness wasn?t just in the past.? Her work gave her hope.? It made our family proud.? And to this day, my Mom is my role model.

Behind every small business, there?s a story worth knowing.? All the corner shops in our towns and cities, the restaurants, cleaners, gyms, hair salons, hardware stores ? these didn?t come out of nowhere.? A lot of heart goes into each one.? And if small businesspeople say they made it on their own, all they are saying is that nobody else worked seven days a week in their place.? Nobody showed up in their place to open the door at five in the morning.? Nobody did their thinking, and worrying, and sweating for them.? After all that work, and in a bad economy, it sure doesn?t help to hear from their president that government gets the credit.? What they deserve to hear is the truth: Yes, you did build that.??

We have a plan for a stronger middle class, with the goal of generating 12 million new jobs over the next four years.

In a clean break from the Obama years, and frankly from the years before this president, we will keep federal spending at 20 percent of GDP, or less.? That is enough.? The choice is whether to put hard limits on economic growth, or hard limits on the size of government, and we choose to limit government.?

I learned a good deal about economics, and about America, from the author of the Reagan tax reforms ? the great Jack Kemp.? What gave Jack that incredible enthusiasm was his belief in the possibilities of free people, in the power of free enterprise and strong communities to overcome poverty and despair.?? We need that same optimism right now.?

And in our dealings with other nations, a Romney-Ryan administration will speak with confidence and clarity.? Wherever men and women rise up for their own freedom, they will know that the American president is on their side.? Instead of managing American decline, leaving allies to doubt us and adversaries to test us, we will act in the conviction that the United States is still the greatest force for peace and liberty that this world has ever known.

President Obama is the kind of politician who puts promises on the record, and then calls that the record.? But we are four years into this presidency. The issue is not the economy as Barack Obama inherited it, not the economy as he envisions it, but this economy as we are living it.?

College graduates should not have to live out their 20s in their childhood bedrooms, staring up at fading Obama posters and wondering when they can move out and get going with life.? Everyone who feels stuck in the Obama economy is right to focus on the here and now.? And I hope you understand this too, if you?re feeling left out or passed by: You have not failed, your leaders have failed you.

None of us have to settle for the best this administration offers ? a dull, adventureless journey from one entitlement to the next, a government-planned life, a country where everything is free but us.?

Listen to the way we?re spoken to already, as if everyone is stuck in some class or station in life, victims of circumstances beyond our control, with government there to help us cope with our fate.?

It?s the exact opposite of everything I learned growing up in Wisconsin, or at college in Ohio.? When I was waiting tables, washing dishes, or mowing lawns for money, I never thought of myself as stuck in some station in life.? I was on my own path, my own journey, an American journey where I could think for myself, decide for myself, define happiness for myself.? That?s what we do in this country.? That?s the American Dream.? That?s freedom, and I?ll take it any day over the supervision and sanctimony of the central planners.?

By themselves, the failures of one administration are not a mandate for a new administration.? A challenger must stand on his own merits.? He must be ready and worthy to serve in the office of president.?

We?re a full generation apart, Governor Romney and I.? And, in some ways, we?re a little different.? There are the songs on his iPod, which I?ve heard on the campaign bus and on many hotel elevators. He actually urged me to play some of these songs at campaign rallies.? I said, I hope it?s not a deal-breaker Mitt, but my playlist starts with AC/DC, and ends with Zeppelin.

A generation apart. That makes us different, but not in any of the things that matter.? Mitt Romney and I both grew up in the heartland, and we know what places like Wisconsin and Michigan look like when times are good, when people are working, when families are doing more than just getting by.? And we both know it can be that way again.?

We?ve had very different careers ? mine mainly in public service, his mostly in the private sector. He helped start businesses and turn around failing ones. By the way, being successful in business ? that?s a good thing.

Mitt has not only succeeded, but succeeded where others could not. ?He turned around the Olympics at a time when a great institution was collapsing under the weight of bad management, overspending, and corruption ? sounds familiar, doesn?t it??

He was the Republican governor of a state where almost nine in ten legislators are Democrats, and yet he balanced the budget without raising taxes. Unemployment went down, household incomes went up, and Massachusetts, under Mitt Romney, saw its credit rating upgraded.

Mitt and I also go to different churches.? But in any church, the best kind of preaching is done by example.? And I?ve been watching that example.? The man who will accept your nomination tomorrow is prayerful and faithful and honorable. Not only a defender of marriage, he offers an example of marriage at its best. Not only a fine businessman, he?s a fine man, worthy of leading this optimistic and good-hearted country.?

?Our different faiths come together in the same moral creed.? We believe that in every life there is goodness; for every person, there is hope.? Each one of us was made for a reason, bearing the image and likeness of the Lord of Life.?

We have responsibilities, one to another ? we do not each face the world alone.? And the greatest of all responsibilities, is that of the strong to protect the weak.? The truest measure of any society is how it treats those who cannot defend or care for themselves.

Each of these great moral ideas is essential to democratic government ? to the rule of law, to life in a humane and decent society.? They are the moral creed of our country, as powerful in our time, as on the day of America?s founding.? They are self-evident and unchanging, and sometimes, even presidents need reminding, that our rights come from nature and God, not from government.?

The founding generation secured those rights for us, and in every generation since, the best among us have defended our freedoms.? They are protecting us right now.? We honor them and all our veterans, and we thank them.

The right that makes all the difference now, is the right to choose our own leaders.? And you are entitled to the clearest possible choice, because the time for choosing is drawing near.? So here is our pledge.

We will not duck the tough issues, we will lead.?

We will not spend four years blaming others, we will take responsibility.?

We will not try to replace our founding principles, we will reapply our founding principles.

The work ahead will be hard.? These times demand the best of us ? all of us, but we can do this.? Together, we can do this.

We can get this country working again.? We can get this economy growing again.? We can make the safety net safe again.? We can do this.?

Whatever your political party, let?s come together for the sake of our country.? Join Mitt Romney and me.? Let?s give this effort everything we have.? Let?s see this through all the way.? Let?s get this done.?

Dwarfs emit gravitational waves

Researchers have spotted visible-light evidence for one of astronomy's most elusive targets - gravitational waves - in the orbit of a pair of dead stars.

Until now, these ripples in space-time, first predicted by Einstein, have only been inferred from radio-wave sources.

But a change in the orbits of two white dwarf stars orbiting one another 3,000 light-years away is further proof of the waves that can literally be seen.

A study to be reported in Astrophysical Journal Letters describes the pair.

Gravitational waves were a significant part of Albert Einstein's general theory of relativity, which viewed space itself as a malleable construct, and the gravity of massive objects as a force that could effectively warp it.

Catching sight of an actual gravitational wave, however, is a tricky business; their effects tend to be tiny and the have so far eluded discovery in Earth-bound experiments.

But the wider Universe provides a laboratory in which the indirect effects of gravitational waves can be measured.

Six-second switch

In principle, any two massive objects orbiting one another can emit gravitational waves, slowly losing the momentum of their orbits into the waves.

The effect is to slightly change the size of the orbits, and the time it takes to complete them.

A measurement of a minuscule change in the orbits of rapidly rotating neutron stars called pulsars garnered the 1993 Nobel Prize in physics.

But pulling off the same trick with visible light has seemed unlikely until now.

It is the extreme nature of the pair of white dwarf stars known as J0651 - each a substantial fraction of our Sun's mass orbiting each other at a distance just a third that between the Earth and Moon - that increases the magnitude of the gravitational waves.

As members of the same team reported in Astrophysical Journal in 2011, the pair orbit each other in less than 13 minutes.

Since that discovery, the team has been keenly watching the pair "eclipse" one another, with each briefly blocking out the other's light as seen from Earth.

Over a period of 13 months, the team saw the orbital period reduce by less than a thousandth of a second, but the effect also shifts when the eclipse time is expected to happen, and that has shifted back by some six seconds since the pair were discovered.

"A lot of these indirect measurements have taken people years, mostly because the orbits are so much longer," explained lead author of the study, JJ Hermes from the University of Texas at Austin.

Mr Hermes told BBC News that he liked the idea that such a groundbreaking result was established in part by using a telescope nearly as old as Einstein's theory: the Otto Struve 2.1m telescope at the McDonald Observatory in Texas.

"There have been 30 years of using radio telescopes and timing pulsars, but this is the first time we've been able to detect the influence of gravitational wave radiation using an optical telescope," he told BBC News.

The team will continue to watch the pair's tightening orbit, and the expected eclipse time should shift back by another 20 seconds by next May. The results will also help guide observations from "direct detection" experiments.

These, such as the proposed eLisa project, aim to measure the tiny relative movements of vastly separated detectors as gravitational waves pass - a final, irrefutable proof that the waves are what relativity predicted so long ago.

"It would be a really nice confirmation if we got one of these laser interferometer missions going - we'd know exactly what to look for," Mr Hermes said.

"We've crunched the numbers, and eLisa would be able to detect this thing in about a week."

Sony's Xperia J arrives in style and on budget, we go hands-on

The Xperia T may have been Sony's flagship phone for this year's IFA, but the company's promised some style for a tighter budget in the form of the Xperia J -- what exactly "budget" means in this case, we're not exactly sure. The style thing we get, however -- the J's a pretty nice looking phone and clearly in the aesthetic vein of its Sony Xperia brethren. The 4-inch FWVGA display is nice and bright (we had to turn it down a bit, even with that white Sony tablecloth in the background) and fairly shiny, offset by a matte black back.

At 9.2mm, Sony's talking up the handset's svelte design. And it's certainly slimmer than a lot of handset we've seen -- though not even closest to the slimmest. It's also not the most powerful handset we've seen by any stretch with a 1GHZ single-core processor inside, but it does a zippy enough job with the Ice Cream Sandwich it's rocking. All in all, the J seems like a fairly solid choice for those who don't want to shell out an arm and a leg on its bigger brother -- although we'll hold off full judgement until we figure out exactly what "budget" means.

The Foam Roller Isn't Doing What You Think It's Doing BDx Fitness

But that doesn?t mean it isn?t doing anything.

If you?ve made to a gym or dance studio, oh, anytime in the past decade you?ve probably noticed a not insignificant number of people sitting on white plastic cylinders. Perhaps you?ve done it yourself. This practice is, of course, foam rollingand involves placing your body?s weight onto specially designed, usually plastic implements and slowly rolling over ?knots? and ?tight? areas in musculature. It has become pervasive in gyms and rehabilitation clinics recently, but has been a common practice for dancers for much longer. The fancy technical name for the foam rolling is self-myofascial release (SMR) and it?s basically a form of self-applied tissue massage. Implements are not limited to the common rollers but to all manner of hard tools, some specially intended for the purpose and others like basketballs and golf balls, decidedly not.

I?m not kidding when I said it?s pervasive. A leading national fitness educator, NASM, explicitly recommends foam rolling. Various fitness and dance gurus such as Sue Hitzman and Yamuna Zake have developed personal methodologies based around self-myofascial release. Where I live in New York there are entire studios dedicated to variations on it. And seemingly every public complaint of injury or pain from dance friends on Facebook is met with enthusiastic instructions to step on a tennis ball or something similar in the post comments.

Advocates for foam rolling advance numerous claims about its benefits to health and fitness ? many of which are common to ?structural? models of massage therapy as well. According to several self-avowed experts ?myofascial release? is reputed to:

? Improve blood circulation throughout your skin, fascia, muscles, and even tendons and ligaments where you can access them with a foam roller. (Dr. Ben Kim)
? ?prevent pain, heal injury, and erase the negative effects of aging and active living?[rehydrate] connective tissue, and [quiet] the nervous system (Sue Hitzmann?s MELT method*)
? Lengthen short (tight) muscles, tendons, and ligaments. (Dr. Ben Kim again)
? ?Align, elongate and tone your entire musculoskeletal system (Yamuna Zake*)

Wow! Heal injury. Improve circulation. Tone your entire musculoskeletal system. That?s an impressive list of potential advantages to foam rolling. Were any of this true, you could just roll around all day and not bother with exercise or technical training. Exaggeration is par for the course when it comes to fitness products, but these are especially egregious. I may surprise you to learn that none of the above claims hold up to scrutiny or can be substantiated empirically.

Before I go on the offensive here I want to emphasize that I don?t think that self-myofascial release or structural massage variants like Rolphing are somehow bad. I am not saying ?don?t foam roll? or suggesting that simply deforming a little myofascial tissue (to the extent that?s even possible) with a hard implement will lead to injury or some other undesirable outcome. Also, I?m limiting this discussion exclusively to SMR and not other common flexibility practices. ?Stretching? is a related, but much larger conversation. I actually enjoy foam rolling occasionally myself and have recommended variations on the practice to several clients over the years ? although for slightly different reasons, as I discuss below. But that?s not the point.

The reality is that dancers in particular have a strong professional interest (whether acknowledged or not) in understanding the anatomic and physiological realities to something like self-myofascial release. Your body is your livelihood and you should be well apprised of the risks and benefits associated with activity done in the name of conditioning. Don?t do something just to do it. Know what you?re trying to accomplish.

Whatever the ?experts? may think is happening when they advocate SMR is not what?s actually happening. Fascia, the abundant connective tissue that invests around muscle, is composed largely of collagen, a widely-used bodily protein. Collagen is hearty stuff and collagenous make-up of fascia gives it tensile strength close to Kevlar. It is physically impossible to permanently change fascia using manual or other techniques. I have seen video of the iliotibial band of fascia used as tow hitch between trucks to demonstrate this tensile strength. As Paul Ingraham, publisher of the essential website Save Yourself, has said: ?If the stuff were much thicker than it is, people would be bulletproof.? Fascia is undoubtedly important to human function. However, the notion that this tissue can be subject to some kind of ?release? is a complete invention, with zero basis in clinical research. Parking yourself on a piece of plastic might feel good, but does nothing to the shape of fascia.

Keeping that fact in mind, let?s examine some of the other claims from above. That ?body rolling? in Yamuna Zake?s parlance will align, elongate, and tone the musculoskeletal system is easily the most specious assertion. Words like ?alignment,? ?elongation,? and ?toning? call to mind imagery that resonate strongly with dancers and fitness consumers. These are marketing terms, pure and simple, and do not describe bodily reality. While it?s true that massage and other practices deform tissue temporarily, they do not permanently elongate anything. (And while were on the subject, no, Pilates will not make your muscles and bones longer). That there is some magical, ideal ?alignment? of the body?s joints is another widely used non sequitur. There are literally an infinite number of ways in which you can choose to ?align? your body, all of them quite temporary as the body constantly moves in space.

And ask yourself, what does ?toning? even mean?

Dr. Ben Kim?s belief that SMR will lengthen short, ?tight? muscles is one that he shares with countless other health and fitness professionals, but that ultimately reflects a poor understanding of how the muscular system actually works. Listen, we need to stop attempting to make ?tight? muscles our explanation for everything that goes wrong in the body. This is a huge flaw in how we conceive of flexibility and muscular function. ?Tightness? is simply not a property that muscle can develop. Muscle does not become tight in the way a knot can be pulled taught. If this were really the case it would prevent joint motion altogether and not just at the end range.

That ?tight? feeling you have at the end range of joint motion or that you feel when you apply your body?s weight onto a foam roller is just that ? a sensation. It could reflect an actively self-generated mechanical condition ? increased resting tension in muscle ? or just a sensation produced in the nervous system. This represents an attempt by the subconcious to communicate something to your conscious awareness. In the end-range joint position that something is that you have reached the limit of the range and that, hey, maybe you should stop. When foam rolling, this discomfort can reflect overall levels of stress and inflammation of the affected tissue. The ?release? you feel during SMR is another sensation. The sustained kneading of muscle and connective tissue stimulates sensory receptors in tendons called golgi tendon organs (GTO). These sensory cells regulate the tension in muscle and when stimulated they decrease that tension in a process called autogenic inhibition. This may feel good, but it also decreases muscle?s force producing capacity.

Tension in muscle, by the way, is modulated completely from the nervous system. It is not a constant quality of muscle and connective tissue but in fact changes ALL THE TIME based on demand. No fictitious myofascial release required. The way the body uses ?tightness? is really like an internally generated splint, a temporary barrier to discourage you from moving around in general or into potentially unstable or dangerous positions. It?s not some mistake the body is making, but something quite purposeful. That doesn?t mean that increased resting tension isn?t disruptive or that you shouldn?t work proactively to eliminate its effects, but the notion that ?short? muscles are somehow the cause of so many problems in the body and deficits to your dance performance is crude and inaccurate ? and SMR will do nothing to affect it.

A related claim about foam rolling and massage, not mentioned above, is that it will break up adhesions that form within the connective tissue ? the fascia in myofascia again ? surrounding muscle. I?ll allow that adhesions may in fact form between muscle and its surrounding fascia. As someone who puts their hands on people for a living, I?ll be the first to acknowledge that the character of tissue varies widely from person to person. Some muscle feels healthy and compliant to the touch, where other feels fibrous and just gnarly. But given that the ?release? thing is more about sensation than the character of tissue, it?s a mistake to assume that this quality is influenced all that much by deformation of myofascia. Why not nutrition, hydration, overuse and other factors first? These things have a direct contribution to the quality of tissue. SMR and massage are both something more contrived. Adhesions, even if they are ?worked out? through massage or SMR, take time (were talking months) to develop. If you foam roll your entire body, feel great, and then in a few days the ?knots? return, then they weren?t really adhesions to begin with. I?ve watched people with the nastiest knots foam roll for years and not feel difference.

Very little research has shown that massage reduces pain in the long term and there is no analogous research covering self-applied massage. The neurological mechanism of autogenic inhibition explains any short-term reduction, but this is tantamount to taking an analgesic. The pain doesn?t really go away. SMR does nothing to address the underlying causes of discomfort. It simply masks the problem by tweaking neuromotor pathways. And there is no evidence that foam rolling will prevent injury. How could it? It decreases the capability for force production in tissue that does little else and impairs accurate sensory signaling to boot. Ditto the claim that massage will increase circulation and speed the removal of waste products from muscle following exercise. In fact, the opposite is true. Massage has actually been shown to decrease blood flow to involved muscle.

So most of the claims to sell you on foam rolling are bogus. But that?s not even the real rub. Foam rolling is not without some real risks to athletes and dancers. It?s worth stating again that autogenic inhibition decreases force production in muscle. Aside from the obvious impediment to vigorous physical activity that having a reduced ability to sequence muscular contraction creates, this, by definition, decreases the ability of muscle to stabilize joints and negatively affects athletic performance. Contrary to the common practice, foam rolling prior to activity really should be avoided. Like sports massage, which tends to be more precise and aggressive, foam rolling does damage muscle and connective tissue temporarily. This damage is usually not severe, but in accumulation it can absolutely create problems. Massage and SMR should be applied sparingly ? certainly not to the same area every day.

The most persuasive reason I can think of to engage in SMR is simply because, to many people, it feels good. I enjoy rolling my hips in particular on days where I feel sore from dance or exercise. As long as foam rolling is performed after practice or workouts and not before, preferably even at the end of the day, the risk is minimal. And despite what I?ve written above it may help with recovery and tissue regeneration in some way. We just haven?t uncovered the mechanism yet. Many of my friends and clients swear by massage and really, who can?t appreciate the psychological benefits gentle tactile sensation on skin and muscle from another person? So go ahead and foam roll, just don?t have any illusions about preventing injury or increasing blood flow.

USPTO Seeks Comment on Possibility of Lowering Most Trademark ...

The U.S. Department of Commerce?s United States Patent and Trademark Office (USPTO) is seeking public comment on the possibility of adjusting trademark application fees, so as to lower the fees for all applicants willing to file and communicate electronically with the USPTO.

The efficiencies achieved by trademark electronic filing and communications have put the USPTO in a position to potentially reduce the overall collection of trademark application fees, and the Office wishes to adjust the fees in a way that further promotes efficiency both for users and the USPTO.? A Notice of Inquiry has been published in the Federal Register.

The USPTO is considering encouraging complete electronic communications by reducing the TEAS Plus filing fee, which currently stands at $275 per class. TEAS Plus is the least expensive application option, and requires electronic communication as well as a complete application and pre-approved identification of goods/services upon filing.

The Office also is considering providing a discount on applications filed using the regular TEAS form, which is $325 per class, assuming the applicant agrees to continue filing and communicating electronically throughout the process.

Parties wishing to use TEAS without totally electronic communication would continue to pay the current per class fee of $325. Comments are also being sought on the possibility of increasing fees on applications based on paper, currently only 1% of trademark applications, given that these applications are more costly and burdensome for the USPTO to process.

While 99% of applicants file under TEAS or TEAS Plus, only 76% of applications remain fully electronic throughout the entire process. To increase efficiency, the USPTO is looking to incentivize end-to-end electronic processing.

The USPTO wishes to learn what rates users believe would be appropriate for the existing methods of filing trademark applications?TEAS, TEAS Plus, and paper?as well as what new level of discount would encourage a TEAS applicant to authorize e-mail communication and file all responses and other documents electronically throughout the application.

The Office also seeks to learn to what extent fee changes would encourage use of TEAS Plus as opposed to a discounted TEAS application with less burdensome requirements. All comments are welcome on these and other questions.

Should the USPTO decide to propose a change in fees, the Office will provide further opportunity for public comment with a Notice of Proposed Rulemaking.

There are ways to prevent termite infestation in your home and the #1 way to do so is simple, easy and worth the money. The top preventative measure is to have your home inspected annually.

A home termite inspection usually runs between $100 and $500, depending on the size of your home. Unless you have an extremely large house (over 5,000 square feet) then it should not cost you more than mentioned here. Complete termite inspection is not a do-it-yourself project because it can be complicated for someone who is not specifically trained in termite detection, and because it needs to be conducted in hard-to-reach places. Though this fact is exactly right, you could still check early signs of termite for final decision to pursue professional inspection later on.

There are a few signs of possible termite infestation that you should keep an eye out for: 1. Mud-looking Material on Wooden Surfaces

When termites eat away at the wooden interior of your home, they will attempt to cover up or patch up the holes they made with dirt. They use dirt as well as their own feces to create a substance to patch these holes, and it looks like mud. 2. Termite Wings

Termites shed their wings when they are swarming. If you notice wings on the ground outside or on the floor in your home then it is definitely cause for concern and cause for inspection. The wings do not necessarily mean that your home is infested with termites, it could be that they passed over your home. This is why an inspection at this point would be essential. 3. The Real Thing!

If you see termites flying around your property (as discussed above, they look like ants with wings) then you should evaluate the situation further by checking closely during the next few days to see if they are still flying around your home. If so, consider finding an exterminator to do an inspection. Termites are usually yellow or white, so if that is what you have observed, then you know what the to do next: Call the exterminator! 4. Termite Tubes

Subterranean termites, which are the kind that cause the vast majority of damage to homes, don't just live in wood like people think. What they do is burrow underground, like ants, where they get the moisture they need to survive. They build their colonies next to a source of wood for food, and then burrow from the earth into the wood, going back and forth between each. To connect these earth and wood burrows, they build termite tubes: little tunnels of earth running along your house that let them run back and forth. 5. Sawdust

Sawdust is a common sign of termites. If you find small unexplained piles of sawdust anywhere in your home then you may have termites.

Finding A Balance Between ?Being Yourself? And ?Being In A - Blog

If ?being yourself? takes up so much of your time, focus, and energy that you don?t have enough time to reasonably consider or do enough things for any potential romantic?partner, then partnering may not be in the cards for you.

If you were to try to calculate how much time each day you have after you take all the time needed to do all the direct and indirect things it takes to ?be yourself,? then how many hours each day might you have to take care of the needs of a partner?

There are some single people who have time for another person.? There are some single people who don?t have enough hours in the average day to take care of their own needs.

I?ve lived in households run by single parents and I?ve lived in households run by couples.? In my limited experience, the single head of households tended to be as busy or busier than the couples.? I remember thinking, ?This person has no time to be in a relationship ? even if they wanted to be in a relationship.? Between their jobs, housework, hobbies, pastimes, special interest groups, and community activities, they have no time for another person in an intimate relationship.?

If you?re a single person, and you make your life so busy you don?t have daily time for another person, then understand it is much less likely you will couple up.? This is not rocket science.

If you?re a single person, and you think you?d prefer to be in a couple, then maybe one of the first things to do is to look at your priorities and how you spend your time, and clear up some regular space in your schedule.? For example, if you don?t have an hour or two each day to socialize or use other methods to filter through and maybe find a potential partner ? then you may not have enough time in your regular schedule for a partner.

And if creating an hour or two each day in your schedule is an unpleasant prospect (because you so love everything else you?re already doing), then maybe that might be?a happier path for you ? remaining single and focusing more on yourself.?

If you prefer working for your church, singing in the choir, and being a part of a Bible study 4 or 5 days a week, then maybe you practically won?t have enough time to care for the needs of another complex human being in a nurturing relationship.

If you prefer reading?a few books a week, rather than facing the regular conflicts and work that come from caring for another human being, then maybe coupling is not your preference.

If you prefer watching football all weekend, playing a role-playing game a couple of hours each night, or spending most weekends camping, then maybe, when combined with all your other activities, work, and responsibilities ? you won?t realistically have enough daily time to be mindful of another person?s wants and needs.

The alternatives are always very good things.? To repeat:? The alternative activities to being in a relationship are almost always really healthy, good, and?pleasant things:? playing games, watching TV, surfing Facebook, bowling league, a great career, or raising a house full of pets.? It?s not that any one of these things is a negative by itself?- it?s that in the aggregate, when all combined, if you do all of those activities regularly ? you may not have enough time to regularly take care of the emotional and social needs of another human being.

There?s nothing wrong with preferring to be single and preferring to spend your time ?being yourself.?? But if you want to be in a relationship, you may benefit from re-examining what ?being yourself? means in the context of making enough regular time to care for another person?s sexual, emotional, bonding, conversational, and many other related needs.

I remember living in households run by single women and thinking:? The problem is not that she can?t find Mr. Right.? The larger problem is:? If she?found Mr. Right, she?d wouldn?t have?time for him.

I?m told from time to time that different strokes work for different folks.? I?ve heard some people theorize that people should remain distinctly individual and separate while being part of a couple.? Leo Buscaglia, a 1980s ?love? guru who once had 5 books simultaneously on the New York Times Bestseller List (but if you read?his?Wikipedia stub, you might think his work is already largely forgotten),?used to talk about how?two people in a relationship?should be like two circles that overlapped?only partially (instead of overlapping completely or one circle being completely inside another).? With this mental construct, two people combined parts of their lives, while keeping most of their lives largely distinct, individual, and separate. ?I?ve?long thought geometric circle analogies, that tried to explain how couples should interact, sucked because of their static?oversimplification in only 2-dimensions.

It should be noted Leo Buscaglia never married and never had to personally show if his theories worked in practice.

In a healthy couple,?each person?is considerate and adaptive to the wants and needs of the other.

I?ve never observed someone who put their own wants and needs above their partner?s?to?be good at relationships.? I?ve seen several people who thought they could put their interests above their partner?s, and who thought they were still good at being a significant other,?repeatedly fail to keep their relationships together.? Some of these people would even?have been considered ?unselfish? or??very giving? people.

But terms like ?selfish? and ?giving? don?t?reveal enough.? Sometimes it?s selfish to meet the needs and wants of your partner.? Sometimes self-preserving drives are very healthy.? Sometimes it?s better to be selfish, because an intelligent selfishness should make it clear that in order to meet more of?your own interests, you might be smarter to meet the interests of the people close to you.? Sometimes it?s better to be intelligently selfish than it is to be charitably self-harming.? Sometimes, the self-benefiting motivations lead us to create better benefits for?others and ourselves.

When you become a partner to someone, you don?t just take on that person in a vacuum ? separate from the rest of their world.? Almost every person comes with a pre-existing social circle of friends and relatives.? When you take on a partner, then almost always, you take?on a great deal of interaction and interdependence with their social circle.

With some people who are less socially connected, this is less of a concern.? But for most socially pleasant and capable people, they come with a social circle.? So, often you?ll need to not only have enough time for your partner, you?ll often also need to make regular time to take care of their social community ? their parents, their children, and their social groups and activities.? It?s all connected.

An irony is:? If you want a really-capable?social partner, but you want them exclusively for yourself ? you?re looking for a combination that may not exist, because people who are really good socially almost always are very?connected to other socially-capable?people.? If you?re vision of ?couplehood? happiness involves taking up all of your partner?s time -?and not having to interact with their social circle ? that combination may rarely exist.? If your partner?has to exclude their social circle in order to satisfy your wants ? that almost always creates conflicts.
